**Verified extract — [Fact — B1]** ABC reported an Agencia Estatal de Seguridad Aérea (AESA) communiqué stating that commercial or professional use of remotely piloted aircraft was not permitted in Spain and never had been. AESA said it could not issue authorizations because no specific legal basis yet existed, so such use was illegal and sanctionable. Recreational craft were treated as Aeromodelos under Real Federación Aeronáutica de España and municipal rules. AESA rejected the belief that a layer up to 400 feet (120 metres) was unregulated, saying its competence extends to the ground. Fully enclosed indoor spaces were outside AESA jurisdiction. Named commercial uses listed as barred included photogrammetry, smart agriculture, graphic reporting, inspection of power and rail lines, border surveillance and fire detection.
